---- — Eric Smith, a rural Lebanon resident who sued the Indiana War Memorials Commission over its policy requiring that protesters get a permit before demonstrating, has won a reversal in his case.
In a unanimous verdict Tuesday, the U.S. Court of Appeals for the Seventh Circuit said a lower court should issue an injunction preventing the memorials commission from enforcing its permit policy, the American Civil Liberties Union said in a press release. The Seventh Circuit justices said the permit policy must be suspended pending resolution of the case.
