Judge orders mediation in lawsuit against county

Boone County — A judge has ordered mediation in a lawsuit filed by Calumet Civil Contractors, Inc., and Valenti-Held Contractor/Developer, Inc., against the Boone County Board of Commissioners.

The mediation will begin Feb. 28, county attorney Bob Clutter told the commissioners. He asked that at least one commissioner attend the session, and requested an executive session be scheduled so that newly-elected Commissioner Donnie Lawson can be brought “up to speed” on the case.

The plaintiffs want $252,238 in compensation for extra expenses they absorbed for excavation and other site work for a part of the Anson development in Whitestown. The work was done in summer 2008.

Bids for the project were awarded in February 2008, the plaintiffs say in legal documents. Work began without a signed contract, however, the plaintiffs claim the work was begun “in order to assist the county in maintaining the project schedule.”
